As F1ash stated, Rosen erred greatly in posting their ambulance chaser suit so quickly after the Mako article, when there was clearly no time for anyone to do any research to establish if a case could be filed IN GOOD FAITH. Then, when they actually had time to do research, they ignored the rebuttals by the company, by an independent scientist who wrote an article on Seeking Alpha, and the FDA's approval of ongoing trials -- but instead repeated unsubstantiated allegations.
It's cheaper for most companies just to pay off these lawyers instead of pursuing legal action. These phony shareholder suits are legal extortion. Rosen may have gotten itself into a world of hurt -- a business-plan-destroying world of hurt -- this time. I sure hope so.
