There was no information from the company making those claims at the time any "reasonable person" would have been thinking of investigating the company, and it is absurd to allege (as Rosen is doing) that someone invested relying in large part upon an old error that requires significant research to find. Anyone who claims that they invested in a company because its lead scientist went to Harvard would be laughed out of court.
In fact, Mako's use of that old stuff (which has been refuted so many times in numerous message board posts) is further proof of his "actual malice" toward Dr. Menon and the company -- which is an important thing to be able to prove in a libel case. Rosen's claim that this is in some way an important issue for shareholder fraud in fact further damages the Rosen/Mako position.
Rosen is desperate because as F1ash (I think it was F1ash) pointed out, they are in deep doo-doo under either theory of their behavior. Technicalities are their only hope of escaping with taking a torpedo amidships.
