According to the lawsuit, Defendants made false and/or misleading statements and/or failed to disclose that: (1) Nobilis claimed success rates for its AccuraScope procedure lacked recognition from any university, medical body, or insurance company; (2) Nobilis overstated its 2014 revenues by as much as $36 million; (3) consequently, Nobilis misrepresented its 2014 revenue growth rate as 161%, when it was actually only 44%; and (4) as a result of the foregoing, Nobilis’s public statements were materially false and misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.
