It's the versions with elevated levels of THC in them that aren't yet legal (except with prescription where medicinal MJ is legal). Even then the feds are still watching for entrepreneurs who cross the wrong lines as the federal classification for MJ hasn't changed. That is what needs to happen to make slip ups less of a concern. It will still be strictly regulated, as it should be. Just like you wouldn't want to give your little kids or grand kids apple juice, and find out the reason their giggling and acting goofy is because the apple juice contained 7% alcohol that the company failed to put it on the label. Same will of course need to be the case with CBD, since it can be formulated with or without THC. In some cases, for certain medicinal applications, various percentages of THC would be advantageous.
