New Study Finds Toxic Chemicals Widespread in Flooring Sold by Top Retailers

A new study found that most vinyl flooring tested contained toxic phthalates, a number of which have been banned in children's products since 2009. The flooring samples tested were purchased from major home improvement retailers including Lowe's and Lumber Liquidators. Researchers found that, of 65 vinyl flooring tiles tested, 38 (58 percent), contained phthalates. Phthalates are commonly found in flooring at levels which exceed U.S. Consumer Products Safety Commission (CPSC) children's product standards for phthalates. The study also surveyed major retailers to assess whether they have adopted policies to eliminate phthalates in flooring. The survey found that The Home Depot is far ahead of its competitors by requiring its suppliers to eliminate ortho-phthalates in all virgin vinyl flooring by the end of 2015.

Class Action Lawsuit Filed Against Lumber Liquidators Alleges That Lumber Liquidators Sold Laminate Flooring Tainted With Dangerously High Levels of Formaldehyde

On March 17th, Andrus Wagstaff and its joint venture partners filed a federal class action lawsuit against Lumber Liquidators alleging that Lumber Liquidators endangered and defrauded their California customers by selling laminate flooring tainted with dangerously high levels of formaldehyde. The lawsuit, Del Braccio v. Lumber Liquidators, Inc., 3:15-cv-01249-JST, filed in the U.S. District Court of the Northern District of California, alleges that Lumber Liquidators defrauded consumers by misrepresenting that its Chinese manufactured laminate flooring complied with California's CARB phase II environmental standards. The flooring allegedly contained formaldehyde levels several times higher than the maximum allowed by law.

Construction defect law firm Robertson & Associates, LLP, filed a RICO class action lawsuit today against Lumber Liquidators, Inc. (NYSE: LL) and the companies Lumber Liquidators has hired to conduct indoor air testing for formaldehyde in its customers' homes. The lawsuit names Building Health Check, LLC, and EDLab, a division of Pure Air Control Services, Inc., of Clearwater, Florida, as co-defendants. The suit alleges that Lumber Liquidators "has hired a mold lab to conduct formaldehyde gas emissions testing and is trying to lull its customers into a false sense of security with the accreditation and proficiency of its chosen lab." The lawsuit seeks an injunction against the defendants from continuing to misrepresent the accreditation of the lab and that the Bio-Badge home test kit is the same as used by "professionals" to test for formaldehyde in indoor air.
