There's a difference between committing fraud and being convicted of fraud. It's certainly possible for a person to commit fraud...and settle out of court by paying fines and admitting guilt...without being convicted.
Again, the SEC and the OSC did investors' due diligence for them. You can see how Mr. Bordynuik purchased the media credits and how he artificially booked them. For those who don't know how accounting works nor understand the lengths Mr. Bordynuik went to in order to commit and hide his accounting fraud, I would encourage them to read the SEC's complaint at https://www.sec.gov/litigation/complaints/2012/comp22220.pdf
The SEC is telling investors that the person who claims to have revolutionized pyrolysis...is also a fraudster. Investors who poo pooed that received an expensive lesson.
Investors who mistook Mr. Bordynuik for an honest man and trusted him when he said he could make oil worth WTI-$3 at a cost of under $10/bbl lost a lot of money to him.
