In my opinion, it's better if the SEC has to continue to bring its enforcement through the courts just like everyone else. I understand that means sometimes fraud will be allowed to continue right in front of everyone's faces but it's better than giving any agency too much power.
I do think the SEC should be more public in their enforcement. I'm very sure that most people didn't know about the SEC's fraud charges against PTOI and Mr. Bordynuik...until I posted the SEC's link in my SeekingAlpha article which was picked up by Yahoo. PTOI certainly wasn't going to inform their investors about the fraud charges--they hide things like that as best they can. It wasn't my article which knocked 15% off of PTOI's share price in 2012--it was that I brought the SEC's suit to investors' attention.
