I received an email back from Dave Lawrence of ihub today in response to my email about the unfairness going on over there with our posts being deleted and we the core group of investors being called scammers, crooks and criminals. As expected it was brushed under the rug and CHP's actions were called permissable. Here is the conversation for those interested:

Hello,

I am a poster on your website, particularly in the SCRC chat room.

I have read all the TOS and TOU rules of the board however it seems to now
be a culture to allow  a select few to post willy nilly, messages that are
off topic and/or personal attacks toward us retail investors.  All posts
have been alerted to admin but they don't even follow up anymore and
certainly do not delete or remove them.

Additionally, posts that we make are deleted by these individuals who are
in moderator positions and when asked to have them recalled, there again is
no communication from the admins (specifically Linda) and the posts are not
reinstated.

I wish you would seriously take a look at the posts going on over on SCRC.
They are blatantly calling us crooks and criminals and it's about time it
stops!

RESPONSE:

There is no such thing per se as "personal attacks against us retail investors." We can only respond to matters that are actionable within the scope of our Terms of Service.

I see you have been complaining about posts referring to "JOSEPH ZAMPETT." That's not actionable. iHub does not make value judgments as to the veracity of user posts nor to do we remove posts on that basis. Unless the post is referring to an identifiable iHub user(s) it is not a matter within our purview. Investors in a stock are not necessarily iHub users.

With all due respect, all my posts have been deleted and upheld by Linda
because I was talking about "groups". Within my post I was speaking about
bashers and naysayers relating to SCRC. Not directing it or calling anyone
specifically a basher or naysayer. My argument is not with comments made about Joe Zampetti. My argument is with Coolerheadsprevail constantly calling our "core" group of investors, criminals and crooks. How is this not off topic or a personal attack. We have identifed ourselves with being by the core and he has no proof that we are criminals.

Anything remotely close to offending him or not agreeing with him on his
posts are deleted by him and there is no proper recourse for us. This guy
has been banned once already and allowed to come back unimpeded to attack the boards users (and if he can generalize and refer to the CORE GROUP OF INVESTORS why can I not refer to bashers or naysayers as a group?)

None of us have come out and said we have been compensated by SCRC (we haven't) and per the TOU a user cannot state that a person has been unless that person has divulged that information publicy on the board.

We're just asking for a level even playing field. It is coming off very
biased and fishy.

RESPONSE:

Bashers and naysayers refer to other posters as a group.

If he was talking about a core group of "pumpers" or "cheerleaders" it might be actionable. But, investors, longs, shorts refer to investors, not users.

The following two responses were UNANSWERED by Dave. Why? Because there is no argument back that makes any sense and justifies the differences between CHP's actions and ours.

The two paragraphs below are what he is exactly in violation of. The "CORE" has been declared a group of original investors in SCRC and are attacked daily. There is no way his postings can be argued as "on topic and not personal attacks".
In contrast to his posts which are condescending to individuals in reply take my post that was deleted by him yesterday. How is that removeable and justifiable to remain so?


Personal Attack
This is when someone attacks one or more members personally rather than the content of that Member's message. The post does not have to be addressed to the "target" of the attack to be considered a Personal Attack. If it attacks a messenger rather than the message, it qualifies for deletion and it is expected that Moderators will remove it.

Off Topic
Posts about or focusing on other Members or groups of people and their reasons for posting on the board (i.e. "XYZDownDaDrain" is just a basher, ignore him", "XYZToDaMoon" is a pumper", "the naysayers are very loud today", "c'mon, where did all the cheerleaders go?". The post does not have to be addressed to a specific person. If the post is about other Users then it should be removed.

Regarding your deletion review request:

Any time you post about Users or reference groups of Posters in your message, this makes your post subject to removal as off-topic and/or personal attack.

Your messages need to focus on the company and the stock and should not contain comments about people who post on the board whether specific or in general. Other posters are never the topic of the board.
