Sure that disgorgement didn't happen after Mr. Bordynuik was caught defrauding investors and, yes, Mr. Bordynuik still has millions of dollars of ill-gotten gains. Is that supposed to give investors comfort??

...and again, the business was highly misrepresented by Mr. Bordynuik. Investors didn't lose money because of the normal risks, investors lost money because the company's story of $10/bbl oil with offers of WTI-$3 was fake. Fraud is not one of the risks which investors are required to shoulder.
