Normally the majority of all civil cases settle before courts render a decision for the reasons you've stated.

The only problem here is that the defendant is the U.S. Gooberment, and there is no individual that would loose if the court finds in favor of the plaintiffs... Basically the delay, in and of itself, is considered a win.
For this reason, I do not believe there will be a settlement for legal reasons, or motivations. However, there is a chance of a release from C-ship for political reasons before the courts render their respective legal decisions IMO... Time will tell.
