Not at all - team Ackman is focusing efforts where justice stands a chance to prevail, verses diluting efforts. This is positive for share holders and in no way demonstrates weakness in our collective goal. It does however, sadly, demonstrate more "ethical" weakness in our political and judicial system - which as an American sucks (but we knew all this anyway & should not be surprised).
Ackman would not have recently strengthened his position to just bail... He is playing an elaborate game of chess and seeks solutions - better to loose a battle in order to win the war! Keep your faith and hang tight.

SENSATIONALISM on the other hand is used every day to bombard us with highly emotional stories to evoke a range of responses... (especially in journalism) the use of exciting or shocking stories or language at the expense of accuracy, in order to provoke public interest or excitement.

There is nothing in the voluntary dismissal that leads to such a conclusion. The plaintiffs have simply removed themselves from expending time, money and effort in a biased court.
Use of the words "screwed" and "bailed" assumes the ability to directly read the minds and emotions of the plaintiffs, which is a highly doubtable and practical impossibility.
A vivid imagination, on the other hand, can work such wonders...

There is NO way to know how Sweeney is going to interpret the law.....and how she is going to rule......Absolutley NO way.....So far, at least 3 judges, have rules against shareholders.....Why would she be any different? The attorneys and plaintiffs clearly recognize that presenting their case to a judge that made a seriously flawed judgement based on a misinformed and misguided opinion in the Perry injunction case is a futile endeavor.

Pershing Square has two active lawsuits - one in Lamberth and the other in Sweeney's court. Recently, the government filed a motion with Sweeney to force a decision 1) Stay the case before Sweeney or 2) Dismiss due to overlaps with the case in Lamberth's court. The 3rd option available to Sweeney was to Deny the motion to stay, but still with risk of government filing for dismissal. What nobody expected was a masterful nuclear-move by Pershing Square to voluntarily dismiss the lawsuit before Lamberth. In this game of Chess, Pershing Square has sacrificed a Knight to announce a Check Mate. No lawsuit in Lamberth's court = No case for government's Motion to Stay. The end result is the continuation of Discovery as ordered by Sweeney. This is very good news for the shareholders as the Sweeney case is the flagship lawsuit with highest win potential.
