Lakeshore has not backed off because they were not in a position to ban medical mj. It is not an issue about agricultural versus industrial, or whether medical mj is an agricultural crop or not. The town, like other towns across Canada, were informed by Health Canada to get their collective acts together when it comes to identifying zones where this crop can be grown or face lawful nonconforming actions where the right to grow is acquired, not permissioned. The matter in Lakeshore is one of the current zoning regulation, not whether they can grow or not - but whether they can expand the processing (which includes apart from drying/sorting/ etc but packaging) area which currently is restricted. It is understood it is agricultural, but with the value added as stated previously. The land use is not an issue in Lakeshore and the two should not be confused. Lawful nonconforming, or grandfathering, cannot be used on Site #1 because there currently exists, prior to the license being granted to CEN, regulations governing activity on that site and a corn grower canner could no more use the lawful nonconforming than could CEN. That point is moot.
I do however think the town will make the company go through the zoning amendment exercise and permission them in, but it will delay not the growing but the processing of the crop. The company still, as heard on the September 23 meeting, have to apply to the town for building permits, etc. to make buildings ready to grow, install water, sewage, electrical, gas and so on to make these facilities a go. The approval will have to come before the infrastructure - the granting of the license will allow them to grow on a limited scale until the rest of the utitilies etc are approved and installed. But that is a positive in my mind. It will allow the company to grow into their ability to grow, rather than begin a large scale operation and potentially encounter problems all growers experience, even the experienced ones. MMPR states the successful applicants still must meet all local zoning to move forward.
