Don't know if this helps as far as bashers claiming an investigation is going on because they don't use the word formal...but thought it was interesting. From our most hated basher janice shell

Isn't the first step a Wells notice about a week before they suspend?
No. Wells notices are only sent when there's a formal investigation in place. And their purpose is to inform the target that the investigation is substantially complete and the SEC is prepared to litigate.
Any Wells notice for INCC is way down the road.
