Update to court case "finally" the Defendants have submitted the order,and the Plaintiffs will be adding ISI as a necessary party!!.I had mentioned that the Defendants needed to add ISI;My bad,they needed to submit the order,it looks like ISI is on the Plaintiffs list!!.
Which is even better...Nowhere does it say TMMI needs to sue HP or ISI's successor....
Also Successor In Interest in this case,
Iterated Systems Inc.."A third party"
The term Successor in interest means a successor to another's interest in property, especially a successor in ownership of a business that is carried on and controlled substantially as it was before the transfer.
Example: A successor in interest is one who follows another in ownership or control of a property. For example: If you sold your home the new owner would be your successor in interest.Would that be DFI?Tom Simpson did sign for the "Source Code" as representative of DFI with Dr.Sloan present back in 2000!!. I'm not sure how this plays out, before the settlement conference,or if it would be used, as leverage with the settlement conference!!.Either way it should be interesting!!..
