Think this through. The purpose of the change to MMPR was to regulate, standardize, control (read tax), and insure public safety. Private citizen grow ops meet none of these criteria and pose potential threats to public safety. The injunction is asking to allow citizens the right to grow their own controlled substance due to financial hardship. Health Canada, in order to facilitate their own law, needs to license new production facilities. If mj is indeed a pharmaceutical drug as it has been designated, unregulated production for resale by private citizens is essentially government sanctioned drug dealing. It seems HC, when instituting MMAR did not foresee the rapid rise in mj patient numbers.
To address the drug price issue market competition is necessary. Currently there are only 13 licensed producers, some selling out of the most popular prescriptions and some taking no new patients. It seems obvious that more mj is needed in the marketplace to supply current demand without addressing future growth.
