There is a descending order of authority starting at federal level. A town could legalize and they do in the US, but business is limited what what people can purchase and carry off on their own. Not a model you can build a big business on.
No I don't expect a PR Tuesday but I do expect one fairly soon!
Here's an example...
Anyone can go outside scrape bark off of a tree put it into a pipe and smoke it if they are stupid and really wanted to lol. It's not illegal right? There is no laws governing it right ? You don't have to ask anyones permission.
Now if the town decides they want to regulate that type of activity they can make laws governing it like where to buy it, where to sell it and from then on you would have to abide by those laws whatever they may be
FITX Stock Message Board http://investorshangout.com/Creative-Edge-Nut...ITX-63675/
LICENSE IS COMING!!!!!!!!!!!!!!!!!!!!!!!!
NOT!!!
point is the town hasn't made those rules.... nothing for me to show you other than the meetings everyone is familiar with...
If we are just going to assume FITX has their license.... well.... ok.... you win... LMAOO.....
You think theres a PR on Tuesday?..... EXPECTING!!!!
I'm not assuming the place is to HC regs because Billiam said it.... I'm not assuming they got an actual inspection just cause Billiam said it....
heck... i don't even know if maybe only the first building is going to be inspected.... and the others will need to wait for more cash infusions.... for buildout.... those pics up of the grow room don't look like that big ol pole barn.... did they ever get a foundation poured in there.... building 2 right!?!?!?....
your right but since the inspection happened and I'm assuming they will get their license any day then yes we're all good we'll have the license
And if your read health canada's guidelines you would realize that they are within their guidelines also
so lets assume they do receive the license very shortly show me the law that says its banned or illegal in the town of lakeshore please
Yes.... exactly what i said... no license no grandfathering....
weed is illegal in canada.... growing weed is illegal in canada... only under very specific rules are those activities allowed.... and only for those licensed by HC....
HC also makes a point of giving towns some right's to decide if a MMJ facility is something they want.... so..... are they going to issue a license within a town that doesn't have rules yet.... HMMMMM?!?!
LMAOOOO....
Technically they will be grandfathered in when they make laws governing medical marijuana and when they receive the license. When they actually come up with the laws and the day in goes into effect that will be the day the grandfathered term will take meaning. Since Medical Marihuana is legal in Canada I would love to see the the town of Lakeshores' law that bans it. If its not allowed please show me the law that bans it or makes it illegal cause other than that once license hits they have done everything legally they are suppose to do to start
LMAO>..... can you show where canadian law allows an unlicensed commercial pot grow?!?!?!
gotta be HC licensed to be grandfathered in... and they got no license from what i've seen....
right??!!!?!??!?!
They weren't growing under MMAR....
The Hells Angels be happy with all the lawyering going on here.... HAHAHHAahaha.... "BUT WE ARE GRANDFATHERED IN!!!"
Can you prove in writing where it says Cen Biotech is not zoned correctly?
By-laws to be rewritten for future expansion and additional grow ops to the town.
No I don't need to prove in writing they are as I'm not the one shouting about it.
This is my only allowed post of the day
If he is not a lawyer than he most likely is telling the truth.
Whatever. You stated they were grandfathered in and I understand what that means. In minnesota they raised the drinking age from 19 to 21. If you were 19 you were grandfathered in.
Oh and by the way the mayor isn't a lawyer if the town wants to challenge then a court will decide not council members or a mayor
I doubt that since they expressed they want the stimulus for the economy
Actually he doesn't provide a source or links that are verifiable for what he alleges the mayor or anyone else said
I never said they did. I said other cities have. But keep thinking that there is not a zoning issue.
Lakeshore is not thinking about or talked about a ban on medical marijuana please stop trying to confuse people
Canadian courts would not deal with the residents' concerns in this situation. That is outside the courts' jurisdiction. Their concern would be whether the city has acted ultra vires its jurisdiction under the Municipal Act, 2001.
if there was an existing marijuana production business and you wanted to start one and were banned by the city this could be a problem. This business is a new business market. Is controversial and there are many concerns. I do not know anything about canadian law but I would guess the courts would have to take the residents concerns as legit.
I'm not sure how Colorado law works, but I am intricately familiar with Canadian law. I doubt a challenge to Richmond council's decision would be unsuccessful. Also, Bill isn't suing Lakeshore, and Lakeshore isn't proposing to make commercial grow ops illegal. In the case of Richmond, municipalities are creatures of statute (Municipal Act, 2001) and are bound in their jurisdiction to follow statute. While they have control over zoning, they may have gone too far in "prohibiting" a specific use. I'm not sure about BC municipal law as I'm only licensed in Ontario, but s. 23.3(1) of the Municipal Act and s. 34 of the Planning Act don't give municipalities the carte blanche zoning power that Richmond seems to be exercising (see: http://www.gowlings.com/knowledgeCentre/publi...legal.pdf).
You may also note that court challenges by businesses in Washington and Colorado have failed. The courts upheld the cities rights as they should.
So bill can go sue whomever if he does not get his way but he will lose.
