I have written Mr. Zack inquiring why he included the JBII case in his book before the SEC had passed judgement on the merits of the case.  At this point we only know that the SEC found that there was enough merit to the allegations to move forward with the case.

If you read the allegations and believe the timeline presented it is hard to believe that JB, and Baldwin, did not know there was an issue with the value of the media credits before they were included in JBI's Form 10-K for the year ended 2009.

Nonetheless, I find it strange that Zack would include an unsettled case in his book.  So I have asked him why he would do that.
