I'm saying it's not a slam dunk that Foley's appeal will be rejected.
Of course, even if he succeeds, he's still guilty of multiple felonies. He never tried, even in this latest appeal, to vacate or nullify the guilty plea. In the government's language, all he did was try to lower to price he pays to have the government drop all the other charges.
And if the government wanted to withdraw the guilty plea altogether on the grounds that Foley has ripped it to shreds on his side, I don't have any idea when the timing for that would be.
If they reopened all the other charges, think about that. All the GlobalVR executives he defrauded would have to testify again, and possibly a whole lot of other people. Even the GlobalVR people, who probably hate his guts, would be annoyed that they've had to testify against the guy umpteen times over the years. And they got their money back from him, most of it anyway, so maybe they just don't have that much taste for revenge.
The more time that passes, the more difficult it becomes to try the case properly. I'm sure that's part of the point of the infinite delays.

The tech guy from New Zealand who was promising a review also punted too - it's been 32 days and he reported "some problems with the unit".

And the beat goes on! NTEK is amazing and we have David Foley to thank for his vision and ground work getting this baby rolling. I have no problem in accepting what ever the court decides in his 8 yr old case. I know that when this is put all behind him he will be back to contribute to the future of NTEK. All aboard the train is leaving hop on.

It all hinges on whether counts in the indictment that are dismissed under the plea bargain should be treated as events that didn't happen, or if they can come back at sentencing, like ghosts. The prosecution says they can come back, and that seems to have been a shock to Foley's apparently not especially competent original legal team.
Those guys were a sledgehammer, but this guy seems to be able to split hairs near to the atomic level.
