That is right. I just said 1-9 cuz 10 can't get anything til those in 1-9 are satisfied (tho POR doesn't have the term satisfied in full on some of those--see class 4-9 defined on POR).
Yes, this is the same Joe Stocks.
>>Is this the same JoeStocks<<
yes it is. And keep in mind why some continued to "shout" down my opinion. 20 cents and others argued that all we needed to get to was "net investment" to see a release from conservatorship, and/or dividends reinstated. I argued that would not be the case, and that we should organize to fight for our shareholders rights by whatever means including a lawsuit. They argued that I was rocking the boat and we should just remain quite and we would get our money. I have traded in and out of FnF shares since pre-conservatorship, and have always held a position oof some size since. Why else would I set up a website for shareholders, and run a facebook page for them?
Now that we have reached well past "net investment" it would appear that I was ciorrect in my initial assessment. Lawsuits did need to be filed and we are fighting for shareholders rights tooth and nail. I have a fairly large position in common, and smaller in preferreds. I posted my most initial buy of commons on the FnF board last fall.
Aint that the truth! But no getting around 323bil allowed.
Then for my and equity sake, we gotta hope no COD.
Hey 2 I simply asked a question, no emotion at all except what YOU injected into it.
Hey gold - my question to you and other couple of people here is this - Dosen't that number INCLUDE ALL claims? That means classes 1 thru 11? TOTAL, not just 1 thru 9. If so then you are TOTALLY misrepresenting this number (if in fact it is correct).
It maybe true mr iron, but it doesn't mean he was wrong. Most people make their reply based on their emotion and I can see that you are not an exemption .
Is this the same JoeStocks that got shot down on every post on the FnF board?
Agreed. Allowed claims will not be amended. $323bil. Sorry I keep posting that # but other posters need to see that #
Goldstandard - There are a lot of big numbers being thrown around.
http://online.wsj.com/articles/lehman-brokera...1408102442
The above link states Lehman had $613B in liabilities when it declared bankruptcy.
http://www.cnbc.com/id/101884109
This one states Lehman reported $639B in assets and has paid 105B which is the largest number I've seen for total payouts to date.
So how much in illiquid assets does Lehman have left to possibly offset the remaining liabilities. Looking to the future, how might they best make use of those assets?
Aha! There was an attraction of attention.
chapter 7
Emergence?
Yes it's possible. It will be part owned by the creditors from some part of illiquid asset that will join the NOL that is owned by the equities.
This speculation is assuming that COD obligation is avoided.
Thanks my good friend. So 323 (let's round) minus 80 bil = $237 bil. Wow....looooong way to go. Only hope then is re-emergence of some sort and they decide to throw a few bones out for equity/others? NOL is it for equity, but I see that is still unclear as to how they can be utilized between u and Joe. So who is right? I have researched NOL in bk over and over, and I still confused. Joe syas they are being utilized now but I don't see how based on what I've read about NOL. How can it be utilized if equity owns it. Equity does own it right? No one else? Let's end this argument now if possible. Everything else is becoming clear to me. For SURE CT's are not part of gen unsecured creditors (I don't care JPM 1.5 bil is mentioned (CT's are NOT in that JPM $ imo)
Amendment of POR maybe possible depending on what is to be amended. Cutting payment to the creditor is impossible considering the losses they already have. Creditors power and right cannot be overlooked.
POR is clear. No need to read into anything to make ourselves feel better. Allowed claims must be sat in full. So its a countdown, simple math. Allowed claims $322-3 billion MINUS ppaid out so far.
Then that number minus the allowed claims still owed the classes before class 10's equals what? Just have to keep subtracting until u get to a respective class, in order as defined by POR.
Right? Then if yes, let's list it out and ibox it. Then we can update as time goes by and more info related to payouts to allowed clains are known. Of course, they can amend POR (with court approval) so I guess that could even change right?
Regarding NOL's-You obviously don't know how the rules work or how to calculate. I have made and used these calculations professionally. You are partially correct in the rules and totally wrong in the calculation . Go back and look at your assumptions with regard to the starting point prior to bankruptcy and you will see the truth. GL
Jersey I am with you. When I read Cotton's posts I immediately wonder what's going on. My head exploded after reading his last few posts.
