The Appeals Court may have opened a Pandora's Box!
Quite right..they should release the source code! They should open all their patents to others just like Tesla opened their patent portfolio!
Someone on ST recently posted that if the patents are no good, what's to stop VRNG from publishing the source code on the web? GOOG seemed still very interested in keeping it secret during the trial.
NET LOSS $21+ Million!
Per their last annual report, ALL cash is from lawsuit settlement! Page 31 of the last annual 10q states that the loss of the search patent lawsuit with Google could have an adverse affect on ANY future litigation. Specifically, they state, "If this were to occur, it will have a material adverse affect on the viability of our company and our operations."
We don't have to PROVE anything. The company OUTRIGHT admits this will CRIPPLE the company. Lawsuits are their ONLY form of revenue!
Does en banc require a precedential case? If not IMO there's some hope for VRNG but if precedential is the standard for en banc, is this one precedential?
IMO it's clearly wrong but that may not be enough to get en banc
Daniel Ravicher tweeted the following:
"$VRNG decision from Court of Appeals overturning jury is shocker, and Chen rightly dissents. An en banc petition surely will be forthcoming."
I think a massive round of forced dumping by institutions take this to the .40 range then lets see.
As A.R. is overstated in the Earnings report, current valuation is set TOO HIGH! Thus, the share price is OVERvalued. The TRUE support line is .025-.55. That is where this is headed. No RALLY will occur before then. IMO
As long as the future bv of the company is overstated, this stock will continue down. Odds are they have the Google settlement proceeds buit into their revenue statement. Thus, every other number is OVERstated. That's a FACT!
You are absolutely 100% correct in your synopsis of the state of this company. Sure, it is worth something, but, that isnt going to stop the garage sell down on Wall Street. Short Sellers are usually Hedge Funds with a short interest this large. And, with that kind of muscle, this will get smashed like a Rat on the road, before they start picking the carcus clean.
A plunging stock that plunged over a lawsuit will continue a dead cat bounce for at least 2 days. There is a dark cloud luming over VRNG. Remember GALT? It had a lawsuit issue. It lost 75% in one day, rallied 10%, & plunged 20 more, before hitting support. This isnt over by any means - .60 is a relative certainty.

I love it! This is great news for longs. With that many shares sold short yet VRNG will bounce quite high in the coming weeks. Now is the time to load up. I plan to buy a bunch more Monday morning and hold for a while.
That is hard to say. If there is no news, I think we will gradually creep back up to the $1.75 range over the next 3-4 weeks; if we receive news, that will change everything. Monday? Who knows. If people realize the huge discount VRNG is now trading at, we might be at $1.50 on Monday. And yes, I meant $1.50.
Acquisitions of patents or other intellectual property assets, which are and will be critical to our business plan, are often time consuming, complex and costly to consummate. We may utilize many different transaction structures in our acquisitions and the terms of such acquisition agreements tend to be heavily negotiated. As a result, we expect to incur significant operating expenses and will likely be required to raise capital during the negotiations even if the acquisition is ultimately not consummated. Even if we are able to acquire particular patents or other intellectual property assets, there is no guarantee that we will generate sufficient revenue related to those assets to offset the acquisition costs. While we will seek to conduct confirmatory due diligence on the patents or other intellectual property assets we are considering for acquisition, we may acquire such assets from a seller who does not have proper title to those assets. In those cases, we may be required to spend significant resources to defend our interest in such assets and, if we are not successful, our acquisition may be invalid, in which case we could lose part or all of our investment in those assets
Thanks for updating, you are correct. I missed that part from the 10Q, so the cash per share is lower than previously posted.
This will have to bounce on short covering! Should go to $1.30!
I conclude with the number of shorts still remaining, that this ain't over yet...
If $VRNG's lawyers are worth anything, they have reviewed the decision and are in the process of doing something about it!
They will come out in the next week or so and request an "en banc" review by the whole court, with the explicit recommendation that "the review is to review the case, not retry the case!"
Else, why does the USPTO even exist? Chen was the only judge on the panel with any "common sense"!
In his dissent, Chen clearly stated the Majority had overreached their job in their conclusion, rendering the jury's job insufficient with the evidence presented to them from both sides, with their "lack of "common sense" reference about the jury, and doing the USPTO's job at the same time.
It was not the Review Court Judges duty to dig this up and present it, it was Google's Attorneys!!! Representation is everything in a balanced court! G's attorneys weren't doing their job at the district level or else we wouldn't have gotten this far!
This will get interesting at some point, but the stock price will suffer in the meanwhile.
And yes, I sold on Friday, too much dust stirred up until $VRNG comes up with an "en banc" request and to see if the request will be accepted!
Politics make strange bed-fellows is an understatement!
Till then, things are a bit "fuzzy", back to "The Rock", climb under and wait for the storm to pass!
I am now a fully dedicated "watcher" with no skin in the game as of now!
JMHO, of course!
GLTA, and a great weekend to boot!
