RIGH still has a window to try to settle, but from a creditors perspective they're a dead company. The debt is already defaulted and Mr. Stanz refused to honor their amended Note that he signed.
That defaulted debt would have been used to acquire two TA's according to $BCAP's MD&A filing.
Short story is the RIGH default caused BCAP multiple delays in effecting its business plan.
Why shouldn't BCAP litigate against RIGH?
Why should BCAP believe Mr. Stanz will proverbially honor his word tomorrow when he refused to honor his word yesterday?
