So, this is a speculative post (my disclaimer) lol
I believe that this is not a simple Form 10 filing. This involves exhonorating KMAG and allowing JR to move ahead with his plans.
KMAG has completed all required SEC/Form 10 tasks and is currently waiting on it's submitted contents to be made public.

Maybe the SEC would not close the case because they didn't want to admit they were wrong and continued dragging their feet. By submitting the Form 10 with the 2 years audited fins to the investigator, he is forcing their hand.. The audited fins validate what he said in his PR's coupled with the fact that the share structure has not changed shows that he is on the up and up. They either have to charge him or allow him to go ahead with the merger.
KMA's management hears shareholders concerns. This process is not as cut & dry as some make it out to be. Patience is needed. Together We Wait.
His FB posts indicate to me that he assumed they would make a decision almost immediately or at a minimum post his Form 10 to Edgar, but that has not happened.
