The Proposed Settlement is comprised of both stock and cash. As of July 10, 2014, the stock component of the Settlement Fund has a value of $415,423. Moreover, JBI has agreed to pay up to $200,000 in total for the claims administration of the Proposed Settlement and to reimburse Lead Counsel for certain expenses related to the mediations in this actions. Lead Counsel will seek an award of 25% of the stock component of the Settlement Fund ($103,855) and reimbursement of up to $35,437 in expenses. If these requests are granted, Lead Counsel will be awarded $139,292, which is 22.6% of the total Settlement Fund value of $615,423. As discussed below, the fee and expense request, which is less than the 25% benchmark set by the Ninth Circuit, is fair and reasonable under applicable legal standards.
