I can see your point, however, the MMs are all about $$$. I think they see how much they could be making based on the last 6 months of trading as well as even the decent volume seen on the greys. Not knowing the details of the suspension, it is hard to speculate, but if it was something minor or easily fixed, then the MM really wouldn't be taking much risk v. reward and I can see them being willing to take the chance. Lets be honest, all of these P&Ds come as no surprise to the MMs, they still take them on, fully knowing they are scams and shells. As long as they aren't liable, they are in it for money and don't care.
