Except, in order to exert a lien, BGL needs to first have one. The decisions of the 5th and 9th court in Mexico were overturned by the Supreme Court, first on the basis of the lower courts not having proper jurisdiction to rule over matters pertaining to National Treasure which mining concessions/land ownership fall under. Given prior decisions of lower courts were over-turned, they simultaneously voided all relief granted in those courts. This includes the lien.
In order for BGL to obtain a lien on Cinco and G.C., its case must be heard in Supreme Court, and the court has to find merit and grant one. Some other conditions as previously mentioned must be in place.
BGL cannot get a default judgment for 'no show' under these circumstances.
