Mr. Bordynuik clearly stated the $10/bbl cost and WTI-$3 as fact. Even if he didn't, those claims were entirely baseless. No reasonable, honest person would have made those claims. Penny stocks like JBII also aren't protected from forward looking statements--the rampant fraud in penny stocks was recognized so penny stocks were specifically excluded from the Private Securities Litigation Reform Act of 1995.
Yes, In the past I've also noticed that many of the references to Mr. Bordynuik's claims are vanishing from the web. I don't know whether that's a result of natural death or a push to delete them. Either way that should make die-hard longs happy since they only seem to care that Mr. Bordynuik's tracks are covered to thwart anyone from pointing out all the negative history.
