That settlement isn't good for shareholders. It carves out a stake from the company to pay for the settlement.
I could be wrong, but I can't imagine the Grampp suit will end up that way. Taking shares out of the company, which is owned by shareholders, to pay shareholders isn't worthwhile. Typically when people sue a penny stock, even if they win it's a loss unless there's some insurance, not to mention the penny stock being sued will almost invariably be out of cash by the time the suit settles leaving the plaintiffs unable to collect and out of luck.
Hopefully Grampp's lawyers are smart enough to go after Mr. Bordynuik himself and those who were enriched by helping him. That's where any recoverable money is going to be.
