On the face of it that sounds good. However, remember the typical police procedure is to tell you you are not under arrest when they start to question you so they don't have to read you your rights, let you have a lawyer, etc. Of course if you try to leave they arrest you and otherwise they'll arrest you when they are good and ready. I don't trust the SEC not to bring a suit just because they are saying there currently is not one. It may be to their advantage not to have instituted one until they have everything they can get first.
Second, if all is innocence, why did Shevin resign? Why did Sterling's wife and Hunt try to dump shares? Somebody knew something was coming and looked out for themselves and shareholders be damned.
Third, assuming the above concerns go away, the stock will be in enough trouble without using any of the A/S for capital, and if they try to, who will want to take it? Now they will have to put any payments in stock on the books at market price. Where are they going to get capital to grow?
