Should Legislators Who Cross-Carpet Lose Their Seats? [opinion]
All Africa Global Media - Tue Feb 04, 1:02AM CST
Historically our pre - independence and 1960 constitutions did not try to regulate the conduct of legislators for reason of the fact that the parties were largely ethnic parties with abiding tribal loyalties. It was therefore unimaginable that elected members of parliament could cross carpet to another party dominated by another ethnic group. In practice it was more common for these parties to try to retain their identities while reaching out to other parties through some electoral alliances as could be seen in the alliance of the NNDP and NPC during the 1964 elections. Under the parliamentary system of government which Nigeria operated between 1960-66, any form of cross carpeting was laden with consequences for the government in power because it would be obliged to resign if it was unable to secure the passage of a major legislation or loses a vote of no confidence. Consequently we did not witness a lot of carpet crossing during the era and it was therefore not necessary to regulate the conduct of legislators. However there is the well reported incident in the Western Region House of Assembly when the NCNC lost the majority to the AG on the floor of the House. The NCNC which was poised to form the government became the minority party which contributed in no small measure to the destabilisation in the Western Region exemplified by the rivalry between Chief Obafemi Awolowo and Adegoke Adelabu as a result of the defections in the Western House. Under the 1979 Constitution there were no provisions dealing directly with the issue of cross carpeting and there were few reported instances of legislators moving across party lines especially in the then PRP and NPP.
