It seems to me that the announcement of the SAIC results as positive, in order to receive a $10 million dollar financing, in May of 2012 followed by a complete retraction of the positive conclusions in the report in October of 2012 could be construed as misrepresentation. I certainly see it that way.

This has nothing to do with the fact that the Executive Summary was leaked. It has to do with how the company sold the report to the "whales" followed by the retraction.
The "things can change in a few months" doesn't fly with me. I doubt it flew with the investors.
It probably didn't fly with SAIC, either.
I don't think we've heard the last of that story.
This dead cat sure didn't bounce very high. I suspect the nine lives are up.
Can the company actually bring a cat back from the dead? Highly unlikely.
Despite the typical "wows" from the usual suspects.
