1. Your Acceptance

5. User Submissions
A. PHARMAJANES does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and PHARMAJANES will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. PHARMAJANES reserves the right to remove Content and User Submissions without prior notice. PHARMAJANES will also terminate a User's access to its Website, if they are determined to be a repeat infringer. A repeat infringer is a User who has been notified of infringing activity more than twice and/or has had a User Submission removed from the Website more than twice. PHARMAJANES also reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. All items purchased using the PHARMAJANES Website are made pursuant to a purchase contract between you the customer and the collective providing the products. This means that the risk of loss and title for such items pass to you upon delivery by the collective to the carrier. PHARMAJANES does not take title or risk of loss; the PHARMAJANES Website merely connects collectives with customers. Risk of loss is a matter between the customer and the collective and delivery service.
12. Product Descriptions
PHARMAJANES attempts to be as accurate as possible. However, PHARMAJANES does not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. If a product offered by the PHARMAJANES WEBSITE itself is not as described, your sole remedy is to return it in unused condition and raise the issue the collective making the delivery.
13. Pricing
Except where noted otherwise, the List Price or Suggested Price displayed for products on the PHARMAJANES Website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. 14. Disputes
Any dispute or claim relating in any way to your use the PHARMAJANES Website, or to any products or services facilitated for sale through the PHARMAJANES Website will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.If for any reason a claim proceeds in court rather than in arbitrationwe each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
15. Applicable Law

All items purchased using the PHARMAJANES Website are made pursuant to a purchase contract between you the customer and the collective providing the products. This means that the risk of loss and title for such items pass to you upon delivery by the collective to the carrier. PHARMAJANES does not take title or risk of loss; the PHARMAJANES Website merely connects collectives with customers. Risk of loss is a matter between the customer and the collective and delivery service.
12. Product Descriptions
PHARMAJANES attempts to be as accurate as possible. However, PHARMAJANES does not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. If a product offered by the PHARMAJANES WEBSITE itself is not as described, your sole remedy is to return it in unused condition and raise the issue the collective making the delivery.
13. Pricing
Except where noted otherwise, the List Price or Suggested Price displayed for products on the PHARMAJANES Website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. 14. Disputes
Any dispute or claim relating in any way to your use the PHARMAJANES Website, or to any products or services facilitated for sale through the PHARMAJANES Website will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.
