bob says he personally put 600000 to 800000 in the project -Geo attorney badgers him about a preceding mou that had been superceded in which the now invalid preceding mou supposedly said 52000 mt would be shipped at 64% iron -w geo complaining that wasnt done --well, surpise surprise geo didnt provide the funds to do so!!!
mining co's require a heavy up front investment in equipment and from what i've seen as bob says in the depo geo didnt provide even the 4 million promised
so Geo att is trying to blame CWRN for not shipping 52000 tons /month - which would be impossible w the funds geo provided- to which bob obviously answered CWRN didnt have the equipment to do that -Geo was responsible for providing funds for the equip but didnt provide enough for that amount of production
geo blames cwrn for not producing more when it was geos reported failure to provide the funds necessary to do so,including alleged commingling and misappropriation of funds, as CWRN claims
Geo att is deposing bob -geo att ,w jimmy listening in on the phone,has to believe what jimmy has told geos attorney -so geos att is hammering away at something that is imo irrelevant as the earlier mou was superceded by other agreements
and geo having the high powered accountants and lawyers primarily drafted the agreements from what i've seen
and geo att is hammering away at the iron% as per preceding superceded mou-which is imo totally irrelevant-
but the purpose of the law is not truth justice or honor as we were taught from 1st day of law school -"forget childish concepts of truth justice and honor-they dont exist anymore and are not our goal- justice is not the goal truth is not the goal- u are hitmen"'
w that kind of ethics in law school-and most w a conscience left in disgust in the 1st few days- I've been fighting that immoral turning upside down of the legal system which began in 1962- u can imagine how bad it is in practice -so the purpose is to manipulate - trip up the witness -which includes strange questions -and witness doesnt have all this info in front of him
-if the purpose was the truth the parties would sit down in an office in a relatively non-intimidating non show business atmosphere and go over the documents, giving Bob the same access to docs that the intimidating geo lawyer has - the witness doesnt know what of many docs.reiterations geo lawyer is often referring to off the top of his head without lawyer being more specific and showing the witness and giving witness time to get his bearings - but depos are purposely not set up to do that=dont allow u to do that
no because the purpose of depo is to throw the witness for a loop to get off his bearings in a very intimidating atmosphere where the opposing att is in control and videotaping to boot -anything to make it more intimidating -its like the inquisition -
its not a process reasonable people would use if the purpose was to determine the truth -which would allow all parties to sit down on an equal footing and go over the docs and have time to recollect events and timing
and what this line of questioning has to do w geos claim to some equipment is beyond me and confusing to me as i read it to p 56 anyway as far as i've got-so u can imagine how confusing it is and it meant to be to the witness,based on my experience
so the purpose is to rattle and confuse in an intimidating atmosphere and then use manipulated testimony at trial -- its medieval and illogical as esp written agreements otherwise prevail over oral testimony
