BGL had 18 months to file an appeal against the ruling handed down to them in August 2011 and chose not to do so.
Most likely they chose not to do so on the advice of legal counsel. BGL tried to have all five mining concessions registered in their name at that time. However, I'd guess as they could not prove ownership, a valid contract (specific performance of their obligations under any previously signed agreement - which was invalid anyway as the person they signed with was not employed by MSJ or SRGE at the time)or proof of purchase, that the court filed judgement against them when they tried to do that. So, they were denied. It seems the Mexican courts even passed judgement against BGL, I would guess "with prejudice" - meaning that, if BGL tried to file an appeal against that judgement in August 2011, it would be thrown out.
Why else has no appeal been filed?
If BGL has such an excellent chance of winning, why haven't they published legal counsel's opinion? If BGL has such an excellent chance of winning, why didn't they file an appeal?
Why is it BGL's website is the only one that lists any current court filings this year in ANY Mexican court but when we ask those who state they have seen them, they cannot provide a link to those same filings they have seen?
Why do all of BGL's press releases state that the voracity of any claims made by them in the press releases has NOT I repeat NOT been checked by the relevant Canadian regulatory authorities?
Instead, it seems obvious to me that once the 18 month deadline passed, MSJ was sure BGL could not win any claim against them and transferred the properties back to themselves and continued negotiations with other parties who had clearly expressed an interest in buying the properties.
If someone can prove otherwise, I'd like to see it.
