#1. Is SFRX in their official paperwork for a salvage claim listing this wreck as an unidentified shipwreck or as a 1715 Spanish Wreck?
#2. Have the Attorney's for SFRX ESTABLISHED in their research whether the wreck is a Merchant ship or a Warship with Military Personnel on Board?
#3. After the Odyssey Fiasco with Spain recently. Do the SFRX Attorney'
think Spain will come after this wreck if it is a Merchant Ship? The Reason I ask is that I've talked to 3 Different Top Admiralty Attorney's in Florida and I've gotten different opinions. The Best Opinion that I've gotten is that if a Spanish Treasure Wreck is Found and it is a Merchant Ship, then Spain has no Claim on it. I am not trying to be negative or stir the pot. I would just like to know if the Attorney's for SFRX have an Opinion on this. I am buying no matter what. I just wanted to know what SFRX thinks and I hope someone beats Spain at their game.
Here are some things to consider with these questions if I was running the show, which I am not .
#1. I would not want to publicly make the claim that a wreck is part of the 1715 fleet until I really had to as this will bring the wrath of Spanish lawyers to the scene even though they will not win as evidence of past experiences with wrecks within 3 miles of the Florida coast (also, see the six wrecks of the 1715 fleet already found a few miles to the south of site 3). However, it does not mean that Spain won't try to claim the wreck. Spain won't win but at this point, they would cause unnecessary headaches. Not a good use of limited funds at this point. I'm not saying it is a part of the 1715 fleet, just that if it is, I would keep quiet on that for now. Although, on the other hand, I think it would help the stock price if they would confirm the wreck is part of the 1715 fleet.
#2. I would certainly verify that the wreck is not a Warship as this would give Spain all the ammo they need to claim the ship and the wreck would be a huge waste of time for Seafarer. So my guess is that Seafarer is pursuing this because they know it is not a Spanish Warship (or French Warship, for that matter). I'm not saying they have verified but I sure would have before pursuing the permit and the contract with Heartland.
#3. I think I answered question 3 with my first two answers but to clarify - Spain has no chance of taking the treasure if the wreck is within 3 miles of the Florida coast UNLESS it is a Spanish Warship in which case it is a lost cause and Spain would get the wreck. Thus my assumption that it is not a warship from any country.
I doubt SFRX attorneys will be commenting on anonymous internet questions nor would SFRX officials but if I was running the company, this is how I would handle these issues.
