NEW YORK, Oct. 17, 2013 (GLOBE NEWSWIRE) -- Morgan & Morgan P.C. and the Law Office of Jana Eisinger PLLC announce that a class action lawsuit has been filed in the United States District Court for the Northern District of California on behalf of all consumers who purchased Unilever's Suave® Professionals Keratin Infusion 30 Day Smoothing Kit (the "Treatment" or "Product") from the date in 2011 that the Treatment was made available to consumers through the present. The case is a nationwide class action, with the exception of residents in the states of Illinois, Alabama, Kentucky, Nevada and Wisconsin. We have separately filed class actions on behalf of consumers in those five states, and the cases are proceeding.
The action is pending against Unilever United States, Inc., LEK Inc., and Conopco, Inc. d/b/a Unilever Home & Personal Care USA, ("Defendants").
As alleged in the Complaint, plaintiffs purchased the Treatment because they believed Unilever's false representations that it would smooth their hair and coat it with Keratin, a protein found naturally in hair. Instead of being a hair smoothing treatment, the Treatment contains an ingredient or combination of ingredients that causes significant hair loss upon proper application. As further alleged in the Complaint, Defendants developed, promoted and sold a defective Product that is unsafe for use as an over-the-counter "smoothing" Kit, they failed to properly test and warn consumers of the safety risks attendant to its use, and Unilever falsely and fraudulently marketed the Treatment and issued a belated and incomplete "recall" of the Product. The Complaint states claims for consumer fraud, breach of warranty, negligence, strict liability and unjust enrichment.
Despite the so-called "recall," the Product is still available for sale on the internet.
