If there are NO stocks to BORROW, then theoretically nobody could short legally.
Poison pills could make it nerve wracking to short a stock. All encumbraces must be liable for. When SKTO finally issues the promised (if they don't that would be a breech of promise) AEGY shares, the shorts are liable for the SKTO shares as well as the AEGY shares.
