Look at the trades in October, there were no where near 9.7 Mil shares bought that month.  So, if he acquired shares in October 2010, where did they come from?  They weren't bought on the open market.  The 2011 10-k clearly state how many shares he holds... 10,587,467.  Nobody is denying that.  However, the 13d states that he is in control of ~9.7 Mil. in the name of 5277 Partners received from an asset purchase agreement between registrant (SIRG) and Medina.  Did he purchase an additional 9.7 Mil shares on top of that?  That would put him holding over 20 Mil. shares  If so why aren't those being claimed in the filings as part of his beneficial holdings?
