still going to do Calif trial- a lot more issues in Calif case where CWRN has 13 causes of action against Geo for up to ca 7.5 mil actual damages and scores of millions punitive-
So this Texas case is more of a harassment and hard negotiating tactic imo (a 1st punch to counteract CWRNs then coming suit against Geo imo) to try to get Bob et al to back down and counteract the millions CWRN might get against Geo in California
I've never seen Brads name anywhere on these legal pleadings- bashers indicated Brad was involved also-Geo tried to get Brad involved but then dropped it-since the timeline of things part of the court action ended in 2011
Geo was not able to manipulate the judge re the arbitration issue, which is a very good sign
Also good that CWRNs lawyer is being more active and arguing points of law with citations
Doubt there will be a settlement at this point given the parties and scores of millions CWRN is asking for in Calif -CWRN should net millions imo if theres any justice- Geos only asking for 1 million plus 956000 for equipment (which CWRN claims it owns)-
but CWRN's much broader/larger complaint argues Geo withheld millions of receipts (thus the stop and go shipping) and perhaps unlawfully profited to the tune of 5 million plus by selling restricted CWRN stock near the high pps point-causing pps to stumble,and CWRN is asking scores of millions in punitive. And Geo has been changing its story re the equipment -which should look suspicious to the court.
These things do not affect present operations and somebody(Brad) who has over 1.15 million hectares of concessions and bought out Bob has the wherewithal to successfully produce in this high profit industry-remember even if the 45000 tons previously at port had already been paid for (which would be extremely unusual),they would've received millions of profit for the 23000 tons trucked in May.
