Your speculation could have foundation...butt,...alas we'll likely never know.
Everything i've read seems to be focused on the possibility of Pfizer...BMS...Merck and lesser known suitors.
With the landscape changing...on an almost daily basis...my deep-pockets suitor would be GSK.
They may be an ocean away...butt,...We have much in common...at opposing ends of the spectrum...they are the Ying to our Yang.
I would have to believe that Sidley leveraged as much as they could...given the circumstances...not their job to prove intent through discovery...butt, simply get the best possible deal for their client...the legality of events is on the plate for the prosecution...and that's Always open for a DEAL...and usually through negotiated dribble...money dictates and provides for No admission of guilt...while the judge rubberstamps...the agreed upon resolution.
