An NDA does not stop the requirement for a 13D SEC filing to be done within 5 business days. That timeline for filing has come and gone. Some have stated that maybe the acquisition of shares was divided amongst a number of companies. A 13d filing is necessary when any controlling entity or person acquires more than 5% of shares. Even if divided between corporations what is of importance is whether voting of 5% or more is under control of a single entity. Run afoul of that and you're subject to a large fine from the SEC.
Where the problem lies is obviously with Refinitiv. All sources that rely on Refinitiv quote the higher institutionally held shares, everyone else doesn't.
