Prosecutors presented a written public statement signed by Stormy Daniels on Jan. 10, 2018, and issued in response to a forthcoming Wall Street Journal story on the payoff she received.
Keith Davidson, Daniels' former lawyer, testified that he prepared the statement, which said, “I recently became aware that certain news outlets are alleging that I had a sexual and/or romantic affair. ... I am stating with complete clarity that this is absolutely false. ... Rumors that I have received hush money from Donald Trump are completely false.”
Prosecutor Joshua Steinglass asked if the statement was true.
“An extremely strict reading of this denial would technically be true,” Davidson responded. “I think you have to go through it word by word.”
“'Sexual and/or romantic affair,'” Steinglass said. “How is that technically correct?”
“I think you have to hone in on the definition of romantic, sexual and affair,” Davidson said.
Asked to explain further, Davidson added: “Well, I don’t think that anyone had ever alleged that any interaction between she and Mr. Trump was romantic,” drawing laughter from Steinglass.
“How about sexual?” Steinglass asked.
“Well, that would be a sexual and/or romantic,” Davidson said.
When Steinglass asked him how he could consider the “hush money” line to be technically accurate, Davidson replied, “It wasn’t hush money and it wasn’t a payoff. It was consideration of a civil settlement agreement.”
