Those FDA emails are now a matter of public record, so if Sidley-Austin has a reason to use them, they could.
CYDY and Amarex agreed to push the deadline from August to November, shortly after those emails came out. It may not be cause and effect, but then again, it might be.
My GUESS, and it's only a guess, is that both sides are waiting to see how damaging this is to the other side's position before locking into a settlement.
And we ALL know what a structured settlement is, if we have ever seen a JD Wentworth commercial.
