I thought the same thing, this is a term from the earliest days of the bashers doing their bashing. At first i though the possibility that the FDA hated Cytodyn must be based on past actions by Nader and Kaz, but the fact that the FDA was using this language suggests they disliked Nader from the start.
I wonder how Nader kept telling investors to not blame the FDA and to not pursue bashing their actions, he was defending the FDA through all of this. seems like he knew he had a bad relationship with the FDA and was doing everything to get on their good side?
I have no idea how Nader could constantly infer Cytodyn would get approvals and favorable treatment when this was the email language being used. could it be the FDA communications directly to Nader and Kaz were diplomatic enough to give them an optimistic feeling?
Cytodyn clearly had no chance ever in getting approvals. all of the fund raising was at investors expense for a totally impossible situation. i think the FDA's explanation or backup to show why they have such a negative opinion is very important because it is very possible a lawsuit against the FDA could be justified. If I was the CEO and this is how the FDA was treating the situation, I would make it very clear that until the FDA gives the clarity on to what this is based on there should be no money wasted on trials etc..
Keep in mind, the FDA had negitive attitude toward Dr J as well, there was really no change of any of the past 5 years resulting in any approval.
