It was enacted because viable production and distribution needs to be in place before approval. The deal consisted of distribution of leronlimab for HIV. Unless there are terms in the contract that specify for HIV anti-viral only then that contract covers all HIV applications. But we know that if Phoenixus AG can't fulfill the terms of the deal then they're gone.

If I remember correctly they'll have to send a chunk of money on approval and have distribution channels already in place. Hard to do when you just had a chapter 11 bankruptcy.
