Amarex is not an LLC with 1 sole purpose. It is a fully-owned subsidiary, operated by NSF high-level executives who retain their NSF jobs, and the CEO of NSF became personally involved, making assurances of proper investigations which were either never carried out or covered up. CYDY can make the case that these assurances induced CYDY to continue the relationship with Amarex, thus costing them a year of wasted time and yielding unusable data which has cost additional years.

These direct actions by NSF, seemingly intended to maintain a business relationship through alleged fraud, are kind of different from an LLC designed to limit liability from one film.
