There seem to be a lot of posts saying that Nader was naive and ignorant about the FDA submission process.
That’ not the legal issue. The issue is that allegedly he knowingly made false statements and sold his stock into the resulting share price increase.
The added complication is that allegedly Kazempour likewise sold stock at that time. Collusion, or Kazempour independently deciding to sell stock based on inside information? (Which of course is also illegal)
The puzzling thing is that allegedly Scott Kelly also sold stock at that time, yet he has not been charged. Was he genuinely ignorant about the untruthfulness of the statements that the application was filed, and just wanted to raise some cash? Or was he aware, but is now a witness for the prosecution?
