clearly as time has passed which is many years, one eyed willie at a minimum has "mislead investors", much of it parallels the fact of no follow up (8K)(disclaimer) he might of been still officially dark then but still zero follow up or transparency
and as time rolls on in years majority of investors have left, so its almost forgotten
