i wonder if there is evidence that Nader and Kaz discussed selling shares prior to the FDA letter. If they had a plan in place and it depended on Kaz filing the BLA to boost the SP, they would be in very big trouble. It is one thing to sell in reaction to forthcoming bad news (which is bad enough) but to file an incomplete BLA in order to boost the SP so they could sell at a top? It is one thing to profit when they know investors will be taking a big hit, it is another to create the inflated SP so they could profit.
This is what i think the SEC is claiming happened, I'm sure Nader and Kaz defense is they did not know what the FDA was going to do or that the BLA was as incomplete as it was. Playing dumb basically.
It just seems strange that they both sold when they did, as much as they both knew the BLA was incomplete, they must have discussed there intentions to sell there stock at that time to each other. I don't think they should be in court separately, they were very coordinated in their actions and i wonder if one will be afraid the other will rat them out on the plan that is verbal amongst only them.
