The FDA is a regulatory agency. They do not hold trials. They do not presume that Amarex or any other company is “innocent until proven guilty” — they investigate, make a finding and act on it.
Do you think there is a trial every time they send a Complete Response Letter to a company, or halt use of dangerous or poorly-manufactured medical devices?
Did they give CYDY a trial, or did they just hastily send out an unsigned letter that squelched CYDY’s deal with the Philippines?
The importance of the FDA going after Amarex cannot be overstated. And they are not going to hold a trial — although if they have found evidence of willful wrongdoing rather than “mere” utter incompetence, then Amarex and its officers could end up in court.
