There may be other issues that are not covered by any arbitration agreement.
For instance: securities fraud. If they allege that Kazempour and Amarex deliberately mishandled things to commit securities fraud, that is not going to be covered by an arbitration agreement that focuses on disputes about work performed. Fraud is a completely different issue. Let's remember, it's not just Nader that is facing legal consequences for his alleged insider trading/pump'n'dump, KAZEMPOUR also has been charged. Illegal acts are certainly NOT covered by the arbitration agreement.
